This Reasonable Use Policy (“Policy”) is hereby presented by Hyos to its Customers as a guide to understand the intended and permissible use of service. The object of the Policy is to prevent exploitation, fraud and abuse of Services.
This policy may be subject to change from time to time and the revised copy is effective immediately upon posting to hyos.com.
The Customer agrees to use Hyos’ services and devices solely for lawful purposes. Hyos’ services cannot be used for transmitting or receiving any illegal, harmful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, profane, racially or ethnically disparaging remarks or otherwise objectionable material of any kind.
This includes, but is not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to a civil liability, or otherwise violate any applicable local, state, provincial, national or international law.
Hyos reserves the right to terminate Service immediately and without advance notice if the Customer violates the above restrictions.
Hyos may consider excessive the use of service where Customer exceeds the average or estimated client base usage patterns, reasonably determined by Hyos from time to time upon its network usage analysis (“Acceptable Usage Pattern”).
Customer’s aggregated usage may be considered outside of normal if it exceeds Hyos’ Acceptable Usage Pattern in conjunction with other factors that may adversely impact other Hyos customers or the Hyos network. Customer is prohibited from using the service or the device for auto-dialing, continuous or extensive call forwarding, telemarketing, fax or voicemail broadcasting or fax or voicemail blasting.
Unlimited Plans are subject to an aggregated voice limit not exceeding Hyos’ Acceptable Usage Pattern, to a maximum of 3000 minutes of use. Usage over the 3000 minutes cap in one billing cycle, will be billed on a per minute basis at the regular Hyos rates of the destinations called.
International Dialing may be enabled upon request. Customer will be required to acknowledge full responsibility for any and all traffic emanating from his device, authorized or otherwise.
Hyos may consider excessive use of the Broadband Internet Service, any circumstance where the Customer is running an application that places excessive bandwidth demands or, where the Customer exceeds the assigned Data limitations. Usage over the monthly data transfer allotment will be charged with $4.00 per each additional Gigabyte of traffic, to a maximum of $80.00. For the avoidance of any doubt, Hyos shall consider reasonable the following Data usage caps:
Monthly Data Download – Business: 250 GB
Monthly Data Upload – Business: 250 GB
Monthly Data Download – Residential: 150 GB
Monthly Data Upload – Residential: 150 GB
Termination for Excessive use
Hyos reserves the right to take immediate action, including but not limited to either suspension or termination of Service, if it determines in its sole and absolute discretion that the use of Service is at any time over the Acceptable Usage Pattern and it adversely affects the Hyos network and/or other customers. Such action does not waive responsibility of any service or usage charges incurred by Customer up to and including the date of suspension or termination.
